本會通過關於香港共產政權根據「維護國家安全條例」對「指明潛逃者」實施措施及新增「通緝」的譴責動議

香港公民代表會議（下稱本會）在二○二四年十二月二十四日以傳閱文件方式通過了以下動議：

The Assembly of Citizens’ Representatives, Hong Kong (hereinafter referred to as “the Assembly”) adopted the following motion via circulated documents on 24^th December, 2024:  

香港共產政權（以下簡稱「港共政權」）通過非法組成的「立法會」非法頒佈的「維護國家安全條例」，發佈行政通知，指定七名香港公民為「指明潛逃者」並新增六名「通緝」人士，其中包括三名前民選代表，當中一人為本會成員許智峯（另外兩名為前立法會議員郭榮鏗及前區議會議員劉珈汶）。此行動導致這七名被指定「指明潛逃者」的香港「特區」護照被非法註銷，其在香港的董事註冊及專業資格亦被暫停或取消。這些行為明確違反了《關於香港問題的聯合聲明（通稱英中聯合聲明）》中的第3(5)條和附件一(13, 14)，儘管該聲明的簽署及實行未得到大多數香港人的同意。

本會強烈譴責港共政權違反聲明的行為，這不僅嚴重影響了被列名個人的人權，還可能做成寒蟬效應，遏制其他香港公民對香港民主的追求。

本會敦促港共政權：  

• 立即撤銷對這些個人的「指明潛逃者」指定及所有關於因香港的政治行為而被「通緝」的人士；
• 廢除違反《關於香港問題的聯合聲明》和《公民與政治權利國際公約》的「維護國家安全條例」。

本會同時敦促國際社會採取適當行動，譴責港共政權的行為並支持香港公民的民主訴求：

• 確保港共政權實施的措施不會對居住在各自國家的指定香港人造成不利影響；
• 向直接或間接受政權措施影響的香港人提供協助（如適用）；
• 承認港共政權和中華人民共和國政府已單方面撕毀《聯合聲明》並採取相應救濟。

Motion on Condemnation of Hong Kong Communist Regime’s “Measures against Absconders” and additional of “Wanted List” by “Safeguarding National Security Ordinance”

The Hong Kong Communist Regime (hereafter referred to as the Regime) has issued an Executive Notice designating seven Hong Kong citizens as “absconders” and adding six additional persons to a “wanted” list, through the unlawful enactment of the “Safeguarding National Security Ordinance” by the unlawful executing “Legislative Council”. This includes three former elected representatives, one of whom is our member, Ted Hui (the other two being former Legislative Council member Dennis Kwok and former District Councilor Carman Lau). This action has resulted in the unlawful cancellation of the passports of these seven individuals and the suspension of their director registrations and professional qualifications in Hong Kong. These actions constitute a clear violation of the “Joint Declaration on the question of Hong Kong” (commonly known as the Sino-British Joint Declaration), specifically Article 3(5) and Annex I(13, 14), despite the declaration not having the consent of the majority of Hongkongers.  

The Assembly strongly condemns the Regime’s violation of the declaration, which has adversely affected the human rights of the individuals listed and has the potential to chill the democratic aspirations of other Hong Kong citizens.  

The Assembly urges the Hong Kong Communist Regime to: 

• Immediately rescind the “absconder” designation for these individuals and all “wanted” status for persons based on political actions in Hong Kong; 
• Abolish the “Safeguarding National Security Ordinance,” which violates the Joint Declaration on the question of Hong Kong and the International Covenant on Civil and Political Rights  

The Assembly also urges the International Community to take appropriate action to condemn the Regime’s actions and to support the democratic aspirations of the Hong Kong citizens:   

• Ensure that the purported measures implemented by the regime do not adversely impact the designated Hongkongers residing in their respective countries.
• Offer assistance, if applicable, to Hongkongers who have been directly or indirectly affected by the measures imposed by the regime.
• Acknowledge the annulment of the Joint Declaration by the Hong Kong Communist Regime and the Government of the People’s Republic of China, and take corresponding remedial actions.
